Gov Gavin Newsom Signs Bill Allowing Gun Crime Victims To Sue Gun Makers & Sellers
The new law "allows individuals, local governments and the California Attorney General" to take legal action against gun manufacturers and gun sellers, according to a release about the bill. In the new law, gun makers & sellers "could face lawsuits if their products are 'abnormally dangerous,' are sold in a way that lets them be illegally converted, or end up in the hands of people who are prohibited from owning firearms." Newsom tweeted a video after signing the bill claiming, "Gun manufacturers & distributors have been shielded from the mass destruction they cause for too long. Today, CA changes that. I just signed a bill that will allow victims of gun violence to sue the makers of these deadly weapons & hold them accountable." He pointed out in the video that the bill he was signing would remove that "Legal Immunity" in California. He is falsely referring to the Protection of Lawful Commerce in Arms Act (PLCAA). The protections in the federal law, PLCAA, do not provide gun makers with "legal immunity," as Gov. Newsom and President Joe Biden like to claim falsely. The protections outlined in the PLCAA do not shield gun manufacturers from lawsuits over defective goods, criminal misconduct on the part of the gun maker, etc. What this is designed to do, is to stop frivolous lawsuits against the gun industry simply because someone used a gun they made in a crime in an attempt to bankrupt the gun industry.
